2. Definitions

Distance Contract:

The contract concluded by means of information technology tools without face-to-face contact, regulating the provision of the service subject to the contract.

Service:

The accommodation service reserved by the BUYER.

Reservation Confirmation:

An email or online system message showing that the SELLER has accepted the BUYER’s reservation request.

3. Subject of the Agreement

This agreement covers the sale and terms of provision of the accommodation service that the BUYER has reserved electronically on the SELLER’s website sunwayclubhotel.com.

5. Price and Payment Terms

• Payment is made via credit/debit card or online payment systems over a secure infrastructure with 3D Secure support.
• The BUYER acknowledges that the reservation is confirmed once payment approval is received.
• If a discount code, promotion, or gift voucher is used, the terms indicated on the payment page apply.

6. Delivery Method and Date

The accommodation service shall be provided at the hotel reception upon presentation of ID or passport by the BUYER on the specified check-in date. Check-in time: 14:00, check-out time: 12:00.

7. Right of Withdrawal

Under Law No. 6502, “services to be performed on a specific date” are excluded from the right of withdrawal. Therefore, the BUYER has no right to withdraw from this contract.

8. Cancellation and Modification Terms

The BUYER may request cancellation or modification under the following conditions before the reservation date:

• Free Cancellation: Up to 7 days before the check-in date without charge.
• 50% Penalty: For cancellations 3–6 days before the check-in date, a 50% fee of the total amount.
• 100% Penalty: For cancellations 0–2 days before the check-in date or in case of no-show, 100% of the total amount.

9. Force Majeure and Alternative Offers

The hotel reserves the right to offer the BUYER a similar facility or alternative dates in case of force majeure, official bans, or natural disasters. Such offers shall consider facility suitability, room size, and price comparison.

10. Buyer’s Obligations

• All information provided during reservation must be accurate, complete, and up-to-date.
• Presentation of official ID or passport upon check-in as requested by the hotel.
• Compliance with the hotel’s general rules and guest conduct regulations.
• Liability for any damage or loss occurring at the facility during the stay.

11. Seller’s Obligations

• Provision of the reserved service on the agreed dates and quality.
• Notification to the BUYER and provision of alternatives in case of any disruptions.
• Protection of collected personal data in accordance with the Privacy Policy.

12. Data Protection

The BUYER’s personal data is processed in accordance with Law No. 6698 on Personal Data Protection (KVKK) and GDPR and is not shared with third parties. For details, see our Privacy Policy.

13. Dispute Resolution and Jurisdiction

Any disputes arising from this agreement shall first be submitted to the Consumer Arbitration Committees; for amounts exceeding their jurisdiction, the Marmaris (Muğla) Consumer Courts shall be competent.

14. Entry into Force

The BUYER declares that they have read, understood, and accepted this agreement by completing the reservation. The agreement enters into force upon confirmation.
